Applicant is seeking withdrawl of amount of Rs.14,01,895/- deposited by respondent/insurance company. The request is opposed by the insurance company. It is contended that there is variance in the percentage of disability as there are two certificates on record. It is further pointed out that there is a delay of 46 days in lodging F.I.R. 2.

Considering the relevant fact that applicant was hospitalized and sustained disability, I find it desirable to permit him to withdraw 50% of the amount.

Civil application is partly allowed permitting the applicant to receive 25% of the compensation with accrued interest on furnishing undertaking and further 25% on furnishing surety/security to the
