DATE : 03RD SEPTEMBER, 2025.
FINAL ORDER :
.
Heard both sides.
2.
These applications are for withdrawal of amount. In First Appeal Stamp No. 10922 of 2025 respondent No. 1 - corporation has deposited an amount of Rs. 8,33,420/- besides statutory deposit of Rs. 25,000/-. In First Appeal Stamp No. 10915 of 2025,
2 972 ca 6965 the respondent No. 1 - corporation has deposited an amount of Rs. 13,90,223/- besides statutory deposit of Rs. 25,000/-. 3.
Both matters are arising out of same accident. Claimants - injured were traveling on motorcycle and met with an accident. 4.
Applications are contested by the respondent No. 1 - corporation. My attention is adverted to the observations recorded by the Tribunal while answering issue No. 3. 5.
I have considered rival submissions of the parties. These are the injury claims. Considering the objection raised, I am not inclined to permit the applicants to receive entire amount deposited by the respondent No. 1 - corporation. Ends of justice would be met by permitting the applicants to receive 70% of the amount deposited with accrued interest.
6.
The civil applications are partly allowed. Applicants - claimants are permitted to receive 70% of the amount deposited with accrued interest on furnishing undertaking to the satisfaction of the Registrar (Judicial) of this Court. Balance amount shall be invested in any nationalized bank. The civil applications are disposed of.
