Mr. Jadhavar, learned counsel for respondents no. 5 and 6 submits that the President and Secretary of the respondent / institution are present in the Court.

Considering the additional affidavit in reply filed by respondents no. 5 and 6, Mr. Wakade, learned counsel for the petitioner submits that prayer clause 'A' does not survive.

The proposal is submitted by the management

2 wp 8071.18 seeking approval to the appointment of the petitioner as per the compromise on 03.04.2007. 4.

In case such proposal is pending, the Education Officer (Secondary), Zilla Parishad, Beed shall decide the same on its own merits, in accordance with law, expeditiously and preferably within four (4) months.

With regard to prayer clause 'D' the primary responsibility to pay the salary is of the management. The management shall pay the arrears of the salary to the petitioner with effect from 02.03.2017 within a period of four (04) months from today. In case some grant in aid is received in respect of post held by the petitioner, the respondents may adjust the said amount.

Writ Petition accordingly stands disposed of. No costs.
