This application is filed by the wife seeking transfer of the matrimonial proceedings lodged by the respondenthusband in the Family Court, Ahmednagar bearing No. HMP No. 94/2024.

It is the case of the petitioner that presently she is residing with her father at Pune. She has three years daughter.
(2) She has to attend the court proceeding at Ahmednagar with her daughter and therefore she finds difficulty to attend the dates at Ahmednagar.

The learned advocate for the respondent opposes the application. He submits that the distance between Pune to Ahmednagar is hardly 100 km. There are facilities available. The cause of action arisen at Ahmednagar where both the parties have resided for considerable time. Considering the distance it is not necessary to transfer the proceedings from the court having the jurisdiction to the court having no jurisdiction. 5.
Considering the fact that the petitioner has to maintain her daughter of three years and certainly it would be difficult for her to attend the dates alongwith daughter, this court is inclined to allow the application. Hence, the application stands allowed in terms of prayer clause-B.
