Per Court :- Present Criminal Application is filed by the Applicant for grant of anticipatory bail, since she is apprehending her arrest in connection with CR No.72/2015 registered with Police Station, Jamner, District - Jalgaon for the offences punishable under Section/s 302, 143, 147, 148, 149, 504, 506 of the Indian Penal Code. [2] Heard Mr. Dheeraj Bansode, learned counsel for the Applicant and Mrs. S.G. Chincholkar, learned Additional Public Prosecutor for the Respondent - State of Maharashtra. [3] Deceased is one Madhukar Wagh, who is brother of the first informant - Bhaskar Sadashiv Wagh. From the First Information
2/2 cri.appln. 3746.15..sxw Report, it is clear that, previous dispute occurred on 30th April, 2015 and actual incident took place on 1st May, 2015. Name of the present Applicant is appearing in the First Information Report however, if the First Information Report is scanned properly then it is clear that, the allegations made against the present Applicant are most general in nature and that she has used the fist blows to the deceased. [4] Looking the nature of accusation made against the present Applicant and looking to the womanhood of the present Applicant, in my view this is a fit case, where-in the court should exercise the discretion. That leads me to pass the following order :-
ORDER
(i) Criminal Application is allowed.
(ii) In the event of arrest, Applicant - SUMANBAI SHAMRAO SAPKALE shall be released on anticipatory bail on she executing P.R. Bond of Rs. 25,000/- [Rs. Twenty Five Thousand.] with two solvent sureties in the like amount, in connection with CR No.72/2015 registered with Police Station, Jamner, District - Jalgaon for the offences punishable under Section/s 302, 143, 147, 148, 149, 504, 506 of the Indian Penal Code.
(iii) With this Criminal Application is allowed and same is disposed of, accordingly.
