It appears that there are injured eye witnesses and the fact that the witnesses identified the accused, has not been properly considered by the trial Court. The case is established for admission of the Appeal, and allowing the Application seeking leave to appeal. 3.

Application is allowed in terms of prayer clause (A), (B), (C) and (F). Application stands disposed of accordingly.

On Admission of the Appeal, Mr. Rudrawar, learned counsel waives service of notice for Respondent No.1.
