Heard the learned Advocates for the parties.

This application is filed by the wife seeking transfer of matrimonial proceeding bearing Hindu Marriage Petition No.120/2022, from the Court of learned CJSD, Ambejogai to the Court of learned Family Court at Latur.

The learned Advocate for the applicant submits that the applicant wife is residing with her parents at Latur. She had already filed petition bearing No.A-259/2022 under Section 9 of the Hindu Marriage Act. One

( 2 ) proceeding for maintenance filed in the Family Court at Latur. Since the husband has not paid the maintenance. Now the execution is also filed in the Family Court at Latur.

Learned Advocate for the Respondent vehemently opposed the application.

To avoid conflicting judgments and for the convenience of the wife, it is appropriate to transfer both the proceedings i.e. Hindu Marriage Petition No.120/2022 and petition bearing No.A-259/2022, to be tried at one place by the same Court. Looking to the conduct of the respondent-husband that inspite of orders, he has not paying the maintenance regularly and execution is required to be filed. 6.

Hence, the following order:

ORDER

(i) Misc. Civil Application stands allowed.

(ii) The proceedings of Hindu Marriage Petition No.120/2022, from the Court of learned CJSD, Ambejogai stands transferred to the Court of learned Family Court at Latur.

( 3 ) (iii) After transfer of the proceeding, the applicant shall not seek unnecessary adjournments. In case the Trial Court finds that the adjournments are unnecessarily sought, the Trial Court may deal with such application, so as to compensate the respondent-husband, if he personally remains present.

(iv) Whenever request is made by the respondent-husband seeking permission to appear through video conferencing, the same shall be considered liberally by the trial Court.
