We have heard Mr.Thorat, learned counsel for the petitioner and learned counsel for Respondents.

Learned counsel for the Respondents raises a preliminary objection that the
2 W.P.No.7236/16 petitioner has an alternate remedy before the Divisional Commissioner.

In view of the fact that the petitioner has an alternate remedy before the Divisional Commissioner, though, Mr.Thorat, learned counsel for the petitioner sought to canvass submission on merits, we are not inclined to consider the same.

The Writ Petition is disposed of with liberty to the petitioner to avail the alternate remedy.

All contentions of the respective parties are kept open.
6.
If the appeal is filed within the period of 15 days from today, the Divisional Commissioner shall consider the appeal within limitation.
