It is not a matter of dispute that there is some civil litigation pending between petitioners and respondents 4 to 8. In view of pendency of litigation in the Civil Court concerning the subject matter involved in this petition, it would not be appropriate to cause interference in exercise of extra ordinary jurisdiction under Article 226 of the Constitution of India. It would be open for the petitioner to claim appropriate relief by tendering appropriate application to the Civil Court. Keeping the option to pursue the remedy available under law, open for petitioners, writ petition stands disposed of.
