It is submitted that, the award has been passed and the amount of compensation has been determined U/Sec. 39 of the National Highways Act, 1956, however, amount of compensation is not paid to the petitioner. The learned A. G. P. submits that, the amount of compensation does not appear to have been appropriately computed with regard to open space and service road.

If the award is already passed, the petitioner would be

2 wp 7570.16 entitled for the amount as per the award, unless the respondents have power to modify the award.

The award is not assailed by any one. The award, it appears is final.

In case there is no objection, then the respondents are required to make payment of the amount determined under the award to the petitioner. The said exercise shall be done expeditiously and preferably within a period of six (06) months from today. The writ petition is disposed of. No costs. [A. M. DHAVALE, J.] [S. V.
