1] The present application is filed by the applicant for suspension of substantive sentence imposed on the applicant in Sessions Case No.513/2022, by order dated 19.05.2025, by learned Additional Sessions Judge-4, Aurangabad. The applicant has been convicted thus: The applicant is convicted for the offence punishable under Section 353 r/w. 149 of the IPC and sentenced to suffer R.I. for one year and to pay fine of Rs.1000/-, IDSI for one month.

The applicant is convicted for the offence punishable under Section 143 r/w. 149 of the IPC and sentenced to suffer R.I. for 6 months and to pay fine of Rs.500/-, IDSI for one month.

The applicant is convicted for the offence punishable under Section 332 r/w. 149 of the IPC and sentenced to suffer R.I. for one year and to pay fine of Rs.1000/-, IDSI for one month.

The substantive sentences of the imprisonment shall run concurrently.

2] The learned counsel for the applicant submits that notices of respondent nos.2 to 5 are awaited and this Court, by order dated 17.07.2025 in Criminal Application No.2314/2025 in Criminal Appeal No.476/2025, has suspended the sentence imposed on the accused nos.2 to 5. The respondent nos. 2 to 5 are co-accused nos.2 to 5. 3] Considering the order dated 17.07.2025 passed by this Court in Criminal Application No.2314/2025, I pass the following order :

ORDER

i] Criminal Application is allowed.

ii] The substantive sentenced imposed on the applicant in in Sessions Case No.513/2022, by order dated 19.05.2025, by learned Additional Sessions Judge-4, Aurangabad, stands suspended till the final hearing and disposal of Criminal Appeal.

iii] The applicant be released on bail on furnishing P.R.bond of Rs.20,000/-, with two sureties in the like amount. Bail before the trial Court.

iv] Criminal Application is disposed of accordingly. v] It is also clarified that the observations made in this order are limited only for the purpose of deciding the present Application.

vi] Criminal Appeal is admitted. On admission, the learned APP waives notice for respondent-State. vii] Call R. & P.

viii] To be heard along with Criminal Appeal No.476/2025.
