Learned Advocate for applicants has produced on record photo copy of death certificate of original accused No.2 Keval Attarchand Duggal. It is stated that he died on 05.06.2023. Under such circumstance, the proceedings in Regular Criminal Case No.130/2023 pending before learned Chief Judicial Magistrate, Ahmednagar stands abated as against original accused No.2.

Now, the parties have compromised the matter. The compromise pursis, which is containing the terms, has been produced on record. Terms of compromise have been got verified through Registrar (Judicial) and learned Registrar (Judicial) has submitted his report dated 20.08.2025. Thus, respondent No.2 has now decided to bury the differences and has given no objection for quashment of the proceedings. Since the dispute that arose was

3_Cri.Appln_2243_2023 matrimonial dispute and now the parties i.e. applicant No.1 and respondent No.2 have decided to part, there is no hurdle in allowing the application. Hence, following order.

ORDER

i) Criminal Application stands allowed.

ii) The proceedings in Regular Criminal Case No.130/2023 pending before learned Chief Judicial Magistrate, Ahmednagar, arising out of First Information Report vide Crime No.373/2023 dated 03.04.2023 registered with Police Station, Tophkhana, Tq. & Dist. Ahmednagar, for the offence punishable under Sections 498-A, 323, 504, 506 read with Section 34 of the Indian Penal Code, 1860, stands quashed and set aside as against applicants viz. 1) Punit Kewal Duggal, 2) Poonam Punit Duggal, 3) Rekha Kewal Duggal and 4) Ankit Kewal Duggal.
