The petitioners are seeking a direction to the State Government to take decision pursuant to the proposal submitted for modification of the development plan as contemplated under section 31(2) of the Maharashtra Regional and Town Planning Act, 1966.

It is pointed out that in spite of the fact that there is a statutory mandate to take decision within a stipulated time which has already expired, the State Government has not taken the decision. 4.

We dispose of the writ petitions by directing the State Government to take a decision upon the report submitted by the Officer appointed and the modifications (subject matter of the petitions) within three months from today.
