Heard learned counsel for the applicant and learned APP for the State.

The applicant is seeking bail in Crime No.147 of 2023 registered with Bembali Police Station, District Osmanabad for the offence punishable under Section 429, 435, 436, 504, 506 r/w 34 of the Indian Penal Code.

It appears that the applicant merely went to the spot of the incident with the main accused who has set the cattle of the complainant to fire. It appears that the applicant has not played active role except going with the main accused. Nothing is to be recovered from him. The applicant is a 25 years old boy having no antecedents to his discredit. Hence, he deserve bail. Hence, the following order :

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Pawan Maruti Pawar, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with the above crime, on the conditions that he shall not tamper with the prosecution witnesses.

(iii) The applicant shall attend the concerned police station as and when called on written notice by the investigating officer, till filing the charge sheet.
