Under the impugned award dated 29.9.2022 the Tribunal Awarded compensation of Rs.54,08,650/- in favour of claimant nos.2 and 3. Insurance Company has deposited the total amount of Rs.69,08,108/- in pursuance of the award with the Registry of this Court.

Present application is moved seeking withdrawal of the amount on behalf of the original claimants.

Learned counsel appearing for the applicants submits that applicant no.2 is taking education in MBBS Course and needs amount for educational expenses.

Considering nature of controversy involved and exigency of applicants, applicant no.2 is permitted to withdraw an amount of Rs.15 Lakh from the amount deposited in this Court and applicant no.3 is permitted to withdraw 5 Lakh. Rest of the amount be kept in Fixed Deposit as per apportionment mentioned in the operative part of the Tribunals Order. Civil application stands disposed off. ( S. G. CHAPALGAONKAR, J. ) ...
