The petitioner who is the accused before the learned Magistrate, had moved Criminal Revision No.208 of 2013 before the learned District Judge-1, Ahmednagar. An application for seeking stay to the proceedings before the learned Magistrate was turned down by the impugned order dated 5.12.2013. On preferring this petition, this Court, by its order dated 31.7.2015, stayed Misc. Application No.174 of 2013 before the Judicial Magistrate F.C., Pathardi.

I have heard Shri Temkar and Shri Hon, learned Advocates for the petitioner and respondent No.2 respectively.

An interlocutory order declining ' STAY ' of the proceedings before the Magistrate is under challenge. Considering the fact that the revision pending the learned District Judge could be decided within a time frame and that this Court has stayed the proceedings before the learned Judicial Magistrate by its order dated 31.7.2015, I am of the view that ends of justice would be met by expediting the hearing in the Criminal Revision so as to be concluded by the end of the year. The order of this Court dated 31.7.2015 could, therefore, be continued till the decision in the Criminal Revision. akl/d

In the light of the above, this petition is disposed off with a direction to the learned District Judge & Additional Sessions Judge, Ahmednagar to decide Criminal Revision No.208 of 2013 as expeditiously as possible and preferably on/or before 23.12.2016. Until then, the ad-interim protection granted by this Court on 31.7.2015 shall be continued. ( RAVINDRA V. GHUGE, J. ) ...
