The petitioner is aggrieved by the order dated 26.5.2017, by which, the Family Court has granted interim maintenance of Rs.3000/- to the respondent / wife from the date of the application which is 7.12.2015.

The petitioner submits that he is a poor agriculturist. In the entire memo of the petition, the petitioner has suppressed the size of the agricultural land that he owns and has also suppressed the income that he derives. A statement is made that he is a Labourer and the ownership of the agricultural land is not divulged.

Even otherwise, the Family Court has noted that the petitioner has an irrigated agricultural land. This aspect was not disputed by the akl/d

BENCH AT AURANGABAD 2- WRIT PETITION NO. 9813 OF 2017 petitioner before the Family Court. So also, a meager amount of Rs.3000/- has been granted by the Family Court. 4.
I find that this petition is a frivolous act of litigation and is devoid of merits. The same is, therefore, dismissed with costs. 5.
The petitioner is directed to pay costs of Rs.5,000/- to the Advocate Associations' Bar Library of Bombay High Court, Bench at Aurangabad.

After the costs are deposited, the petitioner shall produce a receipt before the Family Court, failing which the defence of the petitioner shall be struck off by the Family Court. ( RAVINDRA V. GHUGE, J. ) ...
