Despite the order passed by this Court (Coram: T.V.Nalawade, J.) dated 7th April, 2017, the trial in the case is yet not commenced. On perusal of the report submitted by the Additional Sessions Judge, Parbhani, it appears that the Muddemal property was awaiting and it was finally received on 1st July, 2017. It further appears from the report of the Additional Sessions Judge that the matter was posted for framing of the charge and the said Sessions case was withdrawn from his file and transferred to the Court of learned Sessions Judge, Parbhani. Now, Sessions Case No.79 of 2016, is pending before the learned Sessions Judge, Parbhani. In view of the above, the present application is disposed of with liberty to the Applicant to file an application before the learned
