The Petitioner submits that, because of the purported encroachment by Respondent No.11, a legal injury is caused to him as the encroachment is affecting his business of operating a petrol pump. Because of encroachment, since there are vehicles coming to his petrol pump, certain difficulties are created. 2.

On instructions, the learned Advocate submits that, he would prefer a civil suit, by withdrawing this Petition. 3.

In view of the above, this petition is disposed off, as the Petitioner would prefer a civil suit for the removal of encroachment purportedly committed by Respondent No.11. (Y. G. KHOBRAGADE, J.) (RAVINDRA V. GHUGE, J.) sjk
