Present application has been filed for withdrawal of the amount. Amount of Rs.7,77,207/- has been deposited. The learned Advocate for respondent No.1 submits that the appeal has been filed on the ground that there was breach of terms of policy on the ground of non holding of valid and effective driving license on the date of the accident, however, that has not been considered by the learned tribunal. 2.

Taking into consideration the ground on which the appeal has been filed, case is made out for withdrawal of the amount. Applicant is allowed to withdraw amount of Rs.50,000/- subject to giving undertaking that he would make the said amount good, if directed at
