The applicant is a convict under Sections 302, 376 (2) (f) and 201 of the Indian Penal Code and sentenced to suffer imprisonment for life under Section 302 of IPC; imprisonment for remainder of the natural life of the accused under Section 376 (2) (f) of IPC; and to undergo rigorous imprisonment for seven years under Section 201 of the IPC.
{2} The applicant was the undertrial prisoner and at present, he is in jail. The applicant belongs to a very poor family. Though the applicant has approached the Legal Aid Committee, however, some time has lapsed after the papers are received by the Legal Aid Committee in going through the same. The Counsel representing the applicant-accused is an appointed Counsel from the Legal Aid Panel.
In view of the above and for the reasons stated in the application, delay of two years occurred in fling the Criminal Appeal against the judgment and order dated 18.03.2019, passed by the Additional Sessions Judge, Jalgaon, in Sessions Case No.33/2017, is hereby condoned.
