The learned advocate for the petitioner submits that though by efflux of time, the matter has become infructuous, petitioner who stands superannuated has not been getting the pensionary benefits.

Considering the fact that by way of this petition filed around 2 years back, the petitioner was merely seeking appointment as Junior Clerk in the Ashram School, Gandhinagar, Tq. Kandhar, District - Nanded but now stands superannuated, the matter has become infructuous. If he has some grievance regarding pensionary benefits, it would be open for him to take recourse to law. 4.
