I have heard learned counsel for the applicant for some time. Learned counsel for the applicant has pointed out that the trial court by order dated 14.10.2021 below Exh.3 in Special Case (MCOC) No. 5 of 2021 granted bail to co-accused persons viz. Hiru and Bhagirath. It further appears that the trial court has also granted bail to coaccused Pandurang by order dated 14.10.2021 below Exh.79 in Special Case (MCOC) No. 5 of 2021.

Learned counsel thus, on instructions, seeks leave to withdraw this application with liberty to the applicant to file application for regular bail before the trial court on the ground of change in circumstance that after rejection of application of the present applicant by order dated 19.7.2021, the trial court has granted bail to co-accused persons viz. Hiru, Bhagirath and Pandurang by roder dated 14.10.2021.

Leave granted. The application is dismissed as withdrawn with liberty to the applicant to file application for bail on the ground of change in circumstance that after rejection of the application of present applicant the trial court has granted bail to co-accused persons viz. Hiru, Bhagirath and Pandurang in Special Case (MCOC) No. 5 of 2021.
