The petitioner is seeking a direction to the trial court to expedite the hearing of the criminal case initiated on the basis of an FIR lodged by him for the offence punishable under Section 406, 467,468, 470, 471, 420, 201 read with Section 34 of the Indian Penal Code being R.C.C. No.266/2018.

The learned advocate for the petitioner submits that out of the two accused one has already died and the other is also aged 76 years. Considering the nature of the dispute the petitioner apprehends that he would not get justice if the trial does not get over in the near future. 4.

It transpires that the petitioner has chosen to approach this Court without making any attempt to apply to the trial court for expeditious hearing. We dispose of the petition by granting him liberty to make appropriate application through the learned APP for expeditious hearing before the trial court and the trial court would be obliged to decide it on its own merits.
