Heard learned counsel for the applicant. Nobody appeared on behalf of respondent despite grant of two last chances. The applicant is seeking transfer of HMP No. 33/2020 filed by respondent-husband for getting divorce, from the Court of Civil Judge, Senior Division, Majalgaon, Dist. Beed to the Court of Civil Judge, Senior Division, Aurangabad.

The applicant is not having any source of income. Moreover, she has also filed proceeding under the Protection of Women from Domestic Violence Act, 2005 against the respondent in the Court of concerned Judicial Magistrate, First Class, Aurangabad. The respondent-husband has already appeared in that proceeding. Thus, considering the fact that the respondent -husband is already

attending the Bench at Aruangabad, the aforesaid petition can be transferred to Aurangabad. Considering the convenience of the applicant- wife, following order is passed. :

ORDER

(i) The application is hereby allowed.

(ii) The HMP No. 33/2020 is hereby transferred to the Court of Civil Judge, Senior Division, Aurangabad from the Court of Civil Judge, Senior Division, Majalgaon, Dist. Beed for disposal according to law.

(iii)The respondent is directed to appear before Civil Judge, Senior Division, Aurangabad, on or before 01.03.2023. (iv)The application is disposed of accordingly. (SANDIPKUMAR C. MORE) JUDGE .....
