1] This petition is filed seeking direction to the respondents to give appointment order to the petitioner on the post of Clerk on compassionate ground. Further direction is sought to the respondent Nos. 4 and 5 to implement the order dated 21/07/2013 passed by the respondent No.3.

2] Heard counsel for the petitioner, AGP for respondent Nos. 1 to 3 and counsel for respondent Nos.4 & 5.

3] It is not in dispute that the petitioner is appointed on the post of Laboratory Assistant which is a Class III post. The contention of the counsel for petitioner that the petitioner should have been appointed on the post of Clerk cannot be considered in view of the fact that the post of Laboratory Assistant is also a Class III post like the post of clerk. In that view of the matter, petitioner's grievance is redressed. Further adjudication of this petition is not necessary. Writ petition stands disposed of. [A.M. BADAR, J] [S.S. SHINDE,J] grt/-
