Heard learned advocates for the parties.

This application is at the instance of applicant - wife seeking transfer of Marriage Petition No. 487/2024 from the Court of learned C.J.S.D.-3., Niphad to the Court of learned C.J.S.D., Vaijapur.

The wife has already filed proceeding bearing Criminal Misc. Application No. 146/2025 under section 144 of the B.N.S.S. for maintenance. There is no one to accompany her to travel to

2 958-MCA 206-2025.odt Niphad. It is further pointed out that the respondent - husband is staying at Yewla, a place near to Vaijapur.

The learned advocate for respondent - husband opposes the application. He submits that, the husband has rightly filed the proceedings in the Court at Niphad as the said Court has the jurisdiction to try the marriage petition.

Considering above submissions, this Court finds that, it would be in the interest of justice to transfer the proceedings to the Court at Vaijapur. Hence, following order :

ORDER

(I) Misc. Civil Application stands allowed in terms of prayer clause (B).

(II) After transfer of the proceeding, parties shall not seek unnecessary adjournments. If the Court finds that, adjournments are unnecessarily sought, the parties seeking adjournments shall compensate other side.

(III) With this, Misc. Civil Application stands disposed of. ( KISHORE C. SANT, J. ) P.S.B.
