Heard learned counsel for the applicant and the learned A.P.P. for respondent.

The applicant seeks bail in C.R.No.304 of 2023 registered with Police Station Purna, District Parbhani, for the offences punishable under Sections 302, 201, 120B of the Indian Penal Code and Sections 3, 4, 25 and 27 of the Arms Act. 4.

The applicant sought bail on parity with co-accused Vishal. Learned A.P.P. has correctly pointed out that the allegations attributed against the applicant are different. From his arguments it appears that the role attributed to co-accused Vishal is not identical with the present applicant. However, the accusations against the applicant were that he changed the number plate of vehicle and dropped one of the accused on the spot of the

938-BA-1168-24.odt incident. Considering the role attributed to the applicant and the material investigation against him, it would be inappropriate to keep him behind bar. Hence, the order :-

ORDER

i) The application is allowed.

ii) Applicant Vaibhav Sambhaji Buchale be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He shall not tamper with the prosecution witnesses. (b) He shall attend the trial on each and every effective date.
