Dated: June 11, 2018 ...
PER COURT :- 1.
The petitioner is aggrieved by the order dated 30.1.2017, passed by the District Superintendent of Land Records, Aurangabad ("DSLR"). Grievance is that the petitioners have moved an application before the Deputy Director of Land Records ("DDLR"). Instead of deciding the said application, it appears that the application was placed before the DSLR, who has dealt with the said application. It is pointed out that page No.37 is the said application.
2.
The learned AGP appearing on behalf of the State Authorities confirms that the application dated 21.8.2015 was filed before the 4th respondent and the order passed thereon is by the DSLR. akl/d
IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD 2 - WRIT PETITION NO. 9829 OF 2017 3.
Considering the above, the impugned order dated 30.1.2017 is set aside and application dated 21.8.2015 bearing No. SR-199/2015 is remitted to the office of respondent No.4 for being decided afresh. 4.
The Writ Petition is, therefore, partly allowed. The litigating sides would appear before respondent No.4 on 2nd July, 2018 at 3.00 pm and shall abide by the dates of hearing as may be posted in the matter. It is expected that respondent No.4 would decide the said application as expeditiously as possible and preferably within a period of four months from the date of appeal. If the parties request respondent No.4 to decide the pending application No. SR-186/2014 filed by respondent No.15 herein to be decided along with the above application, the same would be permissible.
