It is the contention of the Petitioner that it's proposals for starting one course, namely, Bachelor of Interior Design and additional divisions in the courses of Bachelor of Business Administration, Bachelor of Computer Application and Bachelor of Science, in their colleges, for the academic year 2023-2024, are pending. These proposals were tendered to the concerned University in the light of Section 109 of the Maharashtra Public Universities Act, 2016, on 27.09.2022.

Section 109(4) of the Maharashtra Public Universities Act, 2016, would enable the State Government to accept such proposals if they are tendered on or before the 1st April.

We are informed that the University forwarded the proposals of the Petitioner in respect of additional courses and new courses, on 02.05.2023.

In view of the above, this Writ Petition is disposed off, expecting Respondent No.1 to consider the proposals forwarded by the University with regard to the Petitioner Institution, on their own merits, preferably on or before 31.08.2023.

We make it clear that we have not expressed any opinion as regards the academic year for which the said courses would be commenced, if granted by the State Government. 6.

The pending Civil Application would not survive and stands disposed off.
