Heard Mr. More, learned counsel for the applicants and Mr. Koralkar, learned counsel for Respondent-acquiring body. 2.

Learned counsel Mr. More points out that the SLAO has awarded compensation at the rate of 90,000/- per Hector for acquired land. The Reference Court enhanced it to Rs. 3,96,000/- per Hector. As such, enhancement is just marginally above 4 times. 3.

In view of the Government policy not to file appeals if enhancement is not beyond four times, in fact, the appeal could not

- 2 - ca8523.24.odt have been filed. Learned counsel Mr. Koralkar opposes the prayer for withdrawal of the amount for the grounds stated in the appeal. 4.

Considering the fact that only 50% amount of award is deposited in this appeal, the claimants are permitted to withdraw entire amount subject to furnishing of usual undertaking to the satisfaction of Registrar (Judicial) of this Court. ( S. G. CHAPALGAONKAR) Judge dyb
