PATIL, JJ Date :19TH SEPTEMBER, 2018 PER COURT :- The petitioners are the owners and possessors of land admesuring 4-H 48-R in Survey No.52/A of village Limbala Makta, Tq. & Dist. Hingoli. It is informed that area to the extent of 4-H has been acquired by the MIDC and 48-R land remained with the petitioners. The petitioners tendered an application to respondent No.2 to measure the land remaining with them. However, it has been informed by the concerned, in view of communication dated 24.11.2017, to secure consent of the Joint Owner i.e. MIDC or to tender the no objection letter. In response to the notice issued by this Court, MIDC has

{2} wp 8608.18.odt caused appearance. There is no serious objection for according sanction for measuring the property in pursuance to the application tendered by the petitioners on 28.11.2017 to the cadastral surveyor.

In the circumstances, we direct respondent MIDC to issue no objection for measuring the property in pursuance to the application tendered by the petitioner to the cadastral surveyor on 28.11.2017 within a period of 15 days from today and on furnishing such no objection, the concerned cadastral surveyor respondent No.2 shall cause measurement of the property, as requested by the petitioner.
