Though the learned Advocate for the appellant has not made available the death certificate, learned APP is submitting a communication dated 11th October 2023 from ASI, MIDC Police Station, Jalgaon along with the true certified photo copy of death certificate, which is in respect of death of Sanjay Shivram Wankhede and the appellant herein is Sanjay Shivram Patil. On the last occasion the learned APP was orally directed to get the confirmation about the surname and whether the person is the same. Now the statement of widow of Sanjay Shivram Wankhede Patil recorded by the concerned ASI on 21st October 2023 has

appeal-286.17 been produced wherein she has stated that he is the same person who was convicted. He was lodged in Nashik Central Jail, however he had come on parole in 2021 but he expired due to Corona Covid-19 on 6th April 2021. The said communications are marked as Exhibit-A and taken on record. There is sufficient material before this Court to arrive at a conclusion that the appellant is no more.

Under the said circumstance, the Appeal stands disposed of as abated.
