PER COURT:

1] Heard learned counsel for the applicant. It has been submitted that respondent No.3 is served through RPAD and the learned counsel for applicant has filed service affidavit on record. In view of aforesaid submission, it appears that despite service of notice respondents have remained absent.

2] Perused the application.

3] For the reasons mentioned in the application, there is no impediment to condone the delay of 155 days caused in filing the first appeal against the impugned judgment and award passed by learned Member, MACT, Sangamner in MACP No.38 of 2009 . Accordingly, the application stands allowed in terms of prayer clause (B). Delay caused for filing the first appeal is hereby condoned. Registry to take requisite steps for further process. 4] On registration of appeal, issue notice to respondents. Call for R. & P. from the concerned Tribunal. After receipt of R. & P. list the matter for admission in due course.
