IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD CONTEMPT PETITION NO.396 OF 2017 (Manohar Laxman Maharnor Vs. Shahaodeo Raosaheb Maharnor and others) IN WRIT PETITION NO.2990 OF 2016 Mr.S.V.Natu, Advocate for the petitioner.

Mr.N.T.Bhagat, AGP for the respondents/State. ( CORAM : Ravindra V.Ghuge, J.) DATE : 07/07/2017 PER COURT :

1.

Learned AGP submits that the Nayab Tahsildar, Georai, upon authorization from the Tahsildar, is present in the Court. Statement is made that the order dated 20/08/2016 shall be complied with within 15 days. Assistance from law enforcing agencies would be taken to ensure the peaceful compliance of the order. It is stated that an attempt to implement the order was made earlier but the Tahsildar fell short of proper police assistance as a mob had gathered for preventing them from implementing the order. A panchnama was also prepared.

2.

It is, therefore, submitted that the order dated 20/08/2016 shall be complied with, without fail, within 15 days from today. khs/JULY 2017/396

3.

Mr.Natu, learned Advocate graciously submits on instructions that this petition can be disposed off as he is interested in having the order implemented rather than prosecuting the officials. 4.

By recording the statement of Mr.Ganesh Sitaram Pawar, Nayab Tahsildar, Georai, as above, this petition is disposed of. ( Ravindra V.Ghuge, J.) khs/JULY 2017/396
