Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The applicant is seeking bail in Crime No.577 of 2023, registered with Bhusawal Railway Police Station (G.R.P. Railway Police Station, Bhusawal), District Jalgaon, for the offence punishable under Section 370 of the IPC.

3. The allegations of kidnapping have been levelled against the applicant that he had kidnapped the children for the purpose of slavery. When the children were taken into the custody, the applicant was not with them. The children were produced before the C.W.C. Their parents have moved an application before the C.W.C. contending that they had handed

over their children to the applicant as a care taker for sending them to the Mothersa. The list of these children, naming the applicant as a care taker has also been placed on record. Those children were taken up for residential course from 01.06.2023 to 15.04.2024. The papers placed on record raises the doubt about the abduction and kidnapping of the children for the illegal purpose. The parents do not directly support the prosecution. They were indirectly supporting the applicant. They had no grievance. Nothing is to be recovered from the applicant. Hence, he deserves bail. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant MOHAMMAD ANJAR AALAM MOHAMMAD SAYYED ALI be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.577 of 2023, registered with Bhusawal Railway Police Station (G.R.P. Railway Police Station, Bhusawal), District Jalgaon, for the offence punishable under Section 370 of the IPC, on the following conditions :

(a) The applicant shall not tamper with the prosecution witnesses.

(b) He shall attend the Police Station as and when called by the Investigating Officer on written notice till filing the charge sheet.
