The complaint is dismissed and the accused is acquitted by holding that the complainant has failed to prove that cheque was given as against existing liability. Advance cheque was given only by way of gift during marriage. The reason given is not convincing and there is good and arguable case in the appeal. So, the application is allowed. Leave is granted. 2.
