This is an application seeking condonation of delay of 99 days caused in filing Second Appeal.

It is stated that due to some communication gap between the appellant and his Advocate, they were initially not aware about the adjudication of the First Appeal, as a consequence of which a delay has occurred in filing of the appeal. The contents of application are supported by affirmation, the non applicants have not filed reply which indicates that the application is not being seriously opposed. 3.

In that view of the matter, I am inclined to condone the delay. Having regard to the reasons mentioned in the application, Civil Application is allowed by condoning the delay.

Put up the appeal for hearing at admission stage on 16.04.2025.
