Heard Mr. Wagh, learned counsel for the petitioner.

Learned counsel submits that the Tribunal has erroneously rejected the Original Application on the ground that the petitioner is challenging the seniority list of the year 2013. The petitioner was only assailing letter dated 4.5.2018 before the Tribunal.

The learned counsel submits that the petitioner would restrict his prayer to the extent that the respondent be directed to consider the petitioner for promotion to the post of Peon as stated in the letter dated 4.5.2018.

We have also heard learned A.G.P.

In the letter dated 4.5.2018 (Exh.I Page 47) the Collector has observed as under : - " तयामुळे आपलेकडील िद. १६.२.२०१८ व िद. १०.४.२०१८ रोजीचे अजारनवये िशपाई पदावर पदोनती देणेबाबतची िवनंती मानय करता येणार नाही. सबब, आपले िद. १६.२.२०१८ व िद. १०.४.२०१८ रोजीचे अजर िनकाली ठेवणयात येत आहेत. तथािप, भिवषयात कोतवाल संवगारतून िशपाई संवगारत पदोनती देणेबाबतची पिकया राबिवणतांना आपलया िवनंतीचा शासन तरतुदीनुसार िवचार करणेत येईल."

The petitioner also now limits his grievance to the extent that as observed by the Collector in the said letter the Collector should abide by it. 7.

Naturally, the Collector would be bound by

wp8177.18 his letter dated 4.5.2018, wherein it is clearly stated that in future if the promotion is to be given for the post of Peon from the cadre of Kotwal, then the contention of the petitioner would be considered as per the relevant Government Resolutions and policy.

In view of that, Writ Petition stands disposed of. No costs.
