IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 968 WRIT PETITION NO.7209 OF 2023 GAURAV VIJAY RABADE

VERSUS

THE STATE OF MAHARASHTRA THROUGH THE SECRETARY AND ANOTHER ...

Advocate for Petitioner : Mr. V.D. Hon, Senior Advocate h/f Mr. Hon Ashwin Vinayak AGP for Respondents/State : Mr. A.S. Shinde

CORAM

: MANGESH S. PATIL & SHAILESH P. BRAHME, JJ.

DATE : 30.06.2023 PER COURT :

Heard.

2.

The petitioner who is armed with several validities of blood relations is seeking validity of his claim as belonging to 'Naikada' scheduled tribe. 3.

We have heard the learned Senior Advocate Mr. Hon for the petitioner who submits that today is the last date for the petitioner to submit the validity otherwise he would lose an opportunity to seek admission. 4.

Mr. Hon would point out that though by the order dated 06.10.2022, on a stand being taken on behalf of the scrutiny committee that it would be reopening the cases of the validity holders, this Court had directed the committee to consider and conclude those cases on or before 31.01.2023 but till date no decision has been taken and the petitioner's proposal has been kept pending.

5.

Suffice for the purpose to observe that the petitioner was already 1/2

968 WP 7209 23.odt before us exactly rather slightly in a better situation when he had filed Writ Petition No. 10348/2022. Considering the short time within which he was soliciting a validity certificate this Court had refused to grant him conditional validity or even refused to issue any direction to the scrutiny committee to take any decision within a stipulated time. 6.

The petitioner does not seem to have learnt any lesson. Again he has filed this petition only a day before yesterday when he is supposed to have a validity certificate by this date.

7.

Admittedly, the petitioner's matter is pending with the scrutiny committee. For the similar reason as were recorded in the order dated 6.10.2022, we dispose of the writ petition by requesting the scrutiny committee to make endeavour to decide the petitioner's claim as expeditiously as possible.

8.

We keep open liberty to the petitioner to approach us again. ( SHAILESH P. BRAHME, J.) (MANGESH S. PATIL, J.) mkd/- 2/2
