PETITION NO. 341 OF 2014 IN WP/8569/2013 DATTATRAYA SOPANRAO IGAVE AND OTHERS

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Petitioners : Mr.Patne Santosh N. AGP for Respondents/State: Mr.V.H. Dighe.

...

CORAM : S.S. SHINDE & P.R. BORA, JJ.

Dated: APRIL 15, 2015 ...

Heard learned Counsel for the parties.

There is consensus between the Counsel for the petitioner and the learned AGP appearing for State that the subject matter of this contempt petition is already taken care of by this Court while deciding the Contempt Petition No.313 of 2014 in Writ Petition No.7661 of 2013 with connected petitions.

The letters dated 2nd February, 2015, 6th February, 2015 and 10th February, 2015, which

341.14cp were produced by the learned AGP have been taken on record of Contempt Petition No.313 of 2014 and those are part of the record of that petition. In view of this, for the same reasons, we pass the following order:

i) In view of the statement of the Respondent - State, as recorded in the order dated 10th February, 2015 in C.P. No.313of 2014 about modifying the said scheme and directions given to do the same within three months, the contempt petition stands disposed of.

ii) However, it would be open for the petitioner to agitate his rights including that of contempt if the State fails to adhere to their statement and directions issued in this petition.
