The petitioner is a third party, who has moved an application Exhibit 67 under Order 1 Rule 10 (2) of the CPC in RCS No.338/2018 contending that he needs to be arrayed in the suit as a defendant because all defendant Nos. 1 to 13 have executed an agreement to sell in his favour on 05/01/2010. The Trial Court has rejected his application by order dated 15/06/2018.

At this juncture, the learned Advocate for the petitioner sought a pass over and after collecting instructions submits that the petitioner desires to withdraw this petition. 3.

In view of the above, this petition is disposed off as withdrawn on instructions.
