Mr. Patil, learned counsel for the petitioner submits that petitioner was initially appointed as Gramsevak. Thereafter, was promoted as village development officer. Petitioner belonged to reserved category and his caste claim is also validated. Petitioner was due for promotion. Even the Promotional Committee found the petitioner to be eligible. Petitioner was not given promotion. Petitioner has given representation to the respondent in September, 2013, however, same is not yet decided. In the meantime, the petitioner stood retired on attaining age of superannuation.

Mr. Tope, learned counsel for respondent submits that, in case, said representation is pending, then the respondent would decide the same on its own merits. In light of that, we pass following order.

O R D E R

In case, the representation given by the petitioner (Exh.D) page 17 is pending with the respondent, then, the respondent shall decide the same in accordance with law and policy and rules expeditiously, preferably within four months.
