IN THE HIGH COURT OF JUDICATURE AT BOMBAY BENCH AT AURANGABAD 968 CIVIL APPLICATION NO.12574 OF 2022 IN FAST/19309/2022 LAXMAN SHRIPAT KARPE THR GPA, NARAYAN LAXMAN KARPE

VERSUS

THE STATE OF MAHARASHTRA THROUGH THE SPECIAL LAND ACQUISITION OFFICER, AURANGABAD AND ANR ...

Advocate for Applicant : Mr. Deshmukh Vaibhav S.

AGP for Respondent - State : Mr. S.

W. Munde ...

CORAM : SANDIPKUMAR C. MORE, J.

DATE : 15.02.2023 PER COURT :

Heard rival submissions. The applicant is seeking condonation of delay of 2793 days which appears to be caused due to his poor financial condition. The learned AGP strongly opposed the application on the ground that there is huge delay. The acquiring body though served, but remained absent.

2.

However, considering the statutory right of the applicant, the delay of 2793 days stands condoned subject to condition that the applicant shall not claim any interest for the aforesaid period of delay. 3.

Appeal be placed for admission after removal of office objections, if any.

4.

The application is accordingly disposed of.
