DATE : AUGUST 18, 2022 ORDER :- This is an application under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in Crime No.0033/2022, registered with Udgir Rural Police Station, District Latur, for the offences punishable under Sections 302, 307, 326, 324, 341, 323, 504, 506, 143, 147, 148 read with Section 149 of the Indian Penal Code and under Section 135 of the Maharashtra Police Act. 2.

Heard learned counsel appearing for the parties. 3.

The similarly placed co-accused has been granted bail by this Court vide order dated 25.07.2022 in Bail Application No.856 of 2022. Present applicant, therefore, becomes entitled for grant of bail on the ground of parity.

In view of the above, the Court is inclined to grant the applicant bail. Hence, the following order:- (i) The application is allowed.

(ii) The applicant be released in connection with Crime No.0033/2022, registered with Udgir Rural Police Station, District Latur, for the offences punishable under Sections 302, 307, 326, 324, 341, 323, 504, 506, 143, 147, 148 read with Section 149 of the Indian Penal Code and under Section 135 of the Maharashtra Police Act. on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount. (iii) The applicant shall not tamper with the prosecution evidence in any manner.

(iv) The applicant shall not enter the village Lohara, Taluka Udgir, District Latur, until conclusion of the trial. [R.G. AVACHAT, J.] KBP
