PER COURT :- 1.

Heard learned Counsel for the applicant and the learned Counsel for the acquiring body on Civil Application for withdrawal of amount.

After considering the grounds of objections raised in memo of appeal in exception to the impugned Judgment and Award, and considering the averments in the application for withdrawal of amount, the applicant is permitted to withdraw: (i) 25% of the deposited amount unconditionally.

(ii) The Applicant is further permitted to withdraw further 25% of the deposited amount on submitting solvent surety in the like amount to the satisfaction of the Registrar agp/-

(iii) The Applicant is further permitted to withdraw further 25% of the deposited amount on furnishing Bank guarantee of any nationalized Bank to the satisfaction of the Registrar (Judicial) of this Court.

(iv) The remaining 25% amount be invested in Fixed Deposit Receipt of any Nationalized Bank, initially for a period of two years and if so required for further period till disposal of the appeal.

Civil Application for withdrawal of amount stands disposed of in above terms.
