I have already held, in Arbitration Application 01 of 2019, that since these matters, challenge the award passed by the arbitrator under Section 3-G(5) of the National Highways Act, 1956, to which Arbitration and Conciliation Act, 1996 is applicable and thus the proceedings under Section 34 shall lie before the District Judge, Osmanabad.

The present matters are also identical in view of which the Registry is therefore directed to transmit these matters to the Court of District Judge, Osmanabad, who upon receipt of the

903 arba 19-19.odt matters, shall register them appropriately. The parties to appear before the District Judge, Osmanabad on 09th August, 2021, before which date, the Registry shall ensure transmission of the record in the present proceedings to the ofce of the District Judge, Osmanabad.
