Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No. 154 of 2024 registered with MIDC Cidco Police Station, Aurangabad, District-
Aurangabad for the offence punishable under Sections 81, 20(b) (ii) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned APP opposed the application stating that the applicant is repeatedly involving in such crimes. 4.
Ganja of 520 gm. has been seized from the applicant. The quantity seized from the applicant was lesser than small quantity. The punishment for such offence is one year. The applicant is languishing in jail for four months. Considering the quantity recovered at the instance of the applicant and the period of his languishing in jail, he deserves bail on certain conditions. Hence, the following order:-
O R D E R
i) Bail Application stands allowed.
ii) The applicant - Anil S/o Ambadas Malve be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in the above crime, on the condition that:-
(a) The applicant shall not tamper with the prosecution witnesses.
(b) The applicant shall not involve in the similar crime.
(c) If the applicant would involve in similar crime, his bail would be cancelled at the instance of the prosecution.
(d) The applicant shall attend the trial on each and every effective date.
