CORAM : S.V.GANGAPURWALA & K.L.WADANE, JJ.

DATED : 6th FEBRUARY, 2017 O R D E R :

We have heard Mr. Nimbalkar, learned counsel for the petitioners.

2.

The order, of which the contempt is alleged is passed on 3.9.2013. The said order expects the State Government to take a policy decision within three months and if the State is

not in a position to finalize any policy, evolve some ad-hoc mechanism to meet the contingencies wherein the education of special children is not prejudiced and continues unobstructed.

3.

Mr. Nimbalkar, learned counsel submits that pursuant to the said order the Government Resolution is issued on 8.4.2015 and still the grants are not released.

4.

The learned A.G.P. states that as per the said Government Resolution it was decided to provide grants to 123 special schools. Thereafter the proposals of the said school were submitted and till now 49 proposals have been scrutinized and forwarded to the Government. The petitioners' school is included in the 49 proposals forwarded to the Government after scrutiny.

5.

In view of that, the contempt stands purged.

6.

The Government may consider release of grants to the petitioners as per the proposal forwarded, expeditiously considering the fact that it is a school for special children.

7.

Contempt Petition disposed of. No costs.
