Advocate Gaikwad holding for Advocate Gaware, learned counsel for the petitioner points out that the instant petition raising challenge to the order passed in Regular Civil Suit No.93/2013 has become infructuous, since the civil suit itself has been dismissed for want of prosecution on 21/09/2019.

Advocate Mhaske, holding for Advocate Karpe, learned counsel for respondent No.1 states on instructions that, no application for restoration of the civil suit is filed.

It is to be noted that, on last date, time was sought to ascertain the position of filing of any kind of restoration application.

In view of the fact that civil suit itself is dismissed for want of prosecution and no restoration application is filed, the instant petition has become infructuous.
